That said however, you qualify for fair use under the copyright laws. You are not hurting the copyright owner’s ability to make a profit from their images, you are making a transformative use (not using them in the same way the copyright owner does), you are not attempting to make a profit. The only thing you can do to make this more “fair use” is to be sure to use only a small fraction of any given collection.

You could take another approach. Tap in all the expenses (payroll, overhead etc) and then find out how much you have to sell in order to reach profit in a reasonable time. With an online financial planning tool, it is fairly easy to do. You just have to experiment with revenue inputs and find out the optimal solution (your revenue forecast to stick in).

LLC works well in this case, in my opinion. The only reasons you would want to consider a S or C Corp. Is if you want to sell shares of the company, to create more capital.

Otherwise, the LLC will do just fine. There is a huge misconception about the LLC. It isn’t just for small businesses. Park Avenue Securities, which is the equities portion of Guardian Life. One of the largest life insurance agency in the U.S. Is a LLC.

Any income earned through the business flows to the owner and primary manager, and is taxed at his/her tax bracket.
